Petition to International Court of Justice: regarding Canada’s unacceptable submission in regard to Palestine

Over 1,000 individuals and more than 35 organizations joined in signing this petition. Musicians including Roger Waters and Bruce Cockburn, former member of Canadian parliament Libby Davies, co-founder of Al-Haq Jonathan Kuttab, faith leaders, academics, lawyers, artists, members of the labour movement, activists, professionals from many walks of life, and concerned citizens joined to let the International Court of Justice know that Canada’s submission was unacceptable. People from across Canada and Quebec, and from many places around the world have spoken out to say Canada’s stance is shameful.

We, the undersigned Canadians and others supportive of the Palestinian cause, beseech the members of the International Court of Justice (ICJ) to ignore the presentation made by Alan H. Kessel, Assistant Deputy Minister and Legal Advisor, Global Affairs, on behalf of the Government of Canada with respect to the request by the General Assembly of the United Nations to the ICJ on the question of Palestine.

The Government of Canada offered two main reasons for opposing the referral to the ICJ:

First – Israel does not agree to the process.

Canada’s submission even contradicts Canada’s official position. Canadian policy says that under

“UN Security Council Resolutions 446 and 465, Israeli settlements in the occupied territories are a violation of the Fourth Geneva Convention, [and] the settlements also constitute a serious obstacle to achieving a comprehensive, just and lasting peace.”

Yet the Canadian submission opposes the ICJ considering the issue of settlements in the occupied West Bank.

Surely, an ‘occupier’ has no standing in the determination of the jurisdiction of the International Court of Justice. The position of the Government of Canada is pure rubbish.

Second – this is not a matter for the UN General Assembly, but for the Security Council.

The sending of the request by the General Assembly to the United Nations Security Council is a thinly veiled attempt to allow the United States of America to use their veto power to keep the matter out of the ICJ.

This position of the Government of Canada is completely wrong headed and unacceptable to most people in Canada as indicated by the undersigned.

To date almost 2,500 letters have been sent to the Canadian government, with no response. Write a  letter.

Canada’s 6-page statement is at odds with its own stated policy, international law and the rights of Palestinians. The Canadian government would do well to review the submissions of organizations such as Al-Haq and countries such as Ireland. Urge Canada to reconsider its stance on an ICJ advisory opinion on Palestine.

Read the ICJ release regarding advisory statements from member states and others.

Might does not make right. Peace without justice is capitulation and continued oppression. [45 similar comments]

The human rights of Palestinians must be addressed as per international law. [33 similar comments]

Whatever the World Court’s opinion on Palestine, any person with eyes to see and a heart to feel knows that there is an ongoing genocide happening… Palestinians, many of them children, are being killed in cold blood in the streets, day after day, year after year. Israel is the perpetrator, and the global community is complicit, preferring to look away at best, and to actively support Israel at worst. The Canadian government should be ashamed of the “friends” it has chosen, in the interest of money and hegemony, but some day the power will shift, and one day the global community could look back on these times with a critical eye. Stand on the side of compassion and justice, speak up about this genocide and Apartheid, before it is too late. [9 similar comments]

Israel does not speak for or represent me, in anything it does, and in this case the Government of Canada is also not representing me. Israel’s oppression and domination of Palestinians, and continued violations of the most basic human rights of those Palestinians, must be highlighted, and Israel must be held to account. [28 similar comments]

Canada must stop condoning the apartheid policies of Israel. L’état d’Israël pratique l’apartheid envers les Palestiniens. [22 similar comments]

I, like so many Canadians, am supportive of the Palestinian cause, and beseech the members of the International Court of Justice (ICJ) to ignore the presentation made by Alan H. Kessel, Assistant Deputy Minister and Legal Advisor, Global Affairs, on behalf of the Government of Canada with respect to the request by the General Assembly of the United Nations to the ICJ on the question of Palestine. [9 similar comments]

Because countries like Canada are basically turning a blind eye and allowing the Israelis free range in the OCCUPIED TERRITORIES, with absolutely no ramifications to their actions, the abuse of the local Palestinians by the Israelis is becoming more and more brutal, with a clear goal of getting rid of the Palestinians, one way or another: by killing them; locking them up without justice, for unlimited time periods; locking up kids; preventing their ability to stay alive by obliterating their means of livelihood (no water, no food, demolishing their homes, their wells, burning their trees, shooting their sheep etc) . I am a Canadian, but also an Israeli. I see the leaders’ behavior becoming increasingly provocative, paying absolutely no heed to human rights and international accords. STOP allowing Israel to commit horrendous crimes against humanity. Stop letting Israel get away with this, just because you are afraid to be named anti-Semitic; stop letting guilt and fear lead you by the nose. [9 similar comments]

Free Palestine [32 similar comments]

Quit following the USA in some of its immoral positions. Stand up as an independent moral country. [19 similar comments]

This is an unconscionable and ignorant recommendation by Canada.  Israel is an apartheid state violating many UN conventions: nuclear weapons, unconventional weapons, torture, incarceration of children in military and adult prisons. [18 similar comments]

As a Jew, the Israeli policy towards Palestine saddens me deeply. It is inhumane, without empathy, as if the government of Israel has forgotten the experiences of the past…those of  being persecuted….Now they have become the perpetrators of persecution…Profoundly tragic, biblical in it’s proportion….. [7 similar comments]

By siding with those who harm, Canada’s governments have implicated its own citizens in the crimes. [2 similar comments]

Has everyone else forgotten (or hidden) the assassinations and torture by the early Zionist settlers of European consuls and other settlers? Of course, a lot depends on whose history one reads, and with what bias……. [5 similar comments]

“I am a ninety year old born in Transcona, Manitoba and have considered myself to be a proud Canadian. I can’t say that anymore!  The correct description now is ashamed. [44 similar comments]

The Palestine tragedy was created by the Western colonial powers, namely Britain, which allowed the Jewish military gangs to infiltrate into Palestine under British Mandatory rule. Hence, it’s time that the West should recognize Palestine as a state & should admit the injustice done to the Palestinian people (most of whom are now homeless refugees). Canada MUST change her policies from blind supporter of Zionist occupation in Palestine to a pacifier who calls for peace in the Middle East.

Please review the Irish submission as an honest and human rights based assessment. [and that of Al Haq]

“I deeply wish that the International Court of Justice (ICJ) will be brave to fulfill its duty to  complete its advisory proceeding on the legal consequences arising from Israel’s policies and practices in the Occupied Palestinian Territory. This would clearly demonstrate to the world that the ICJ is dedicated to There are at least five substantive legal points which must be commented upon in the ICJ’s findings: : i) right to self-determination; ii) the inherent illegality of the occupation; iii) the prolonged occupation including unlawful use of force; iv) acquisition of territory by force specifically annexation and settlements; and v) discriminatory legislation and measures specifically apartheid.

I hope that you will proceed without interference from Israeli or Canadian influence which only seek to evade the development of a just and equitable solution for both states there. Truth is more powerful than prejudice and violence, and efforts to hide the truth will come undone ultimately. Thanking you in advance. “

The over-gloried myth of Canadian peace-keeping has evaporated as Canada’s follies in Somalia, Haiti and Afghanistan have exposed the ugly belly of the beast. It is embarrassing that Canada as a nation through its government plays the puppet and shrills for the occupying force of Israel denying land and rights to the Palestinian nation. Canada at the UN should forfeit its seat and sit behind the US ambassador as a useful servant stooge.
