Over 1,000 individuals and more than 35 organizations joined in signing this petition. Musicians including Roger Waters and Bruce Cockburn, former member of Canadian parliament Libby Davies, co-founder of Al-Haq Jonathan Kuttab, faith leaders, academics, lawyers, artists, members of the labour movement, activists, professionals from many walks of life, and concerned citizens joined to let the International Court of Justice know that Canada’s submission was unacceptable. People from across Canada and Quebec, and from many places around the world have spoken out to say Canada’s stance is shameful.
We, the undersigned Canadians and others supportive of the Palestinian cause, beseech the members of the International Court of Justice (ICJ) to ignore the presentation made by Alan H. Kessel, Assistant Deputy Minister and Legal Advisor, Global Affairs, on behalf of the Government of Canada with respect to the request by the General Assembly of the United Nations to the ICJ on the question of Palestine.
The Government of Canada offered two main reasons for opposing the referral to the ICJ:
First – Israel does not agree to the process.
Canada’s submission even contradicts Canada’s official position. Canadian policy says that under
“UN Security Council Resolutions 446 and 465, Israeli settlements in the occupied territories are a violation of the Fourth Geneva Convention, [and] the settlements also constitute a serious obstacle to achieving a comprehensive, just and lasting peace.”
Yet the Canadian submission opposes the ICJ considering the issue of settlements in the occupied West Bank.
Surely, an ‘occupier’ has no standing in the determination of the jurisdiction of the International Court of Justice. The position of the Government of Canada is pure rubbish.
Second – this is not a matter for the UN General Assembly, but for the Security Council.
The sending of the request by the General Assembly to the United Nations Security Council is a thinly veiled attempt to allow the United States of America to use their veto power to keep the matter out of the ICJ.
This position of the Government of Canada is completely wrong headed and unacceptable to most people in Canada as indicated by the undersigned.

Canada’s 6-page statement is at odds with its own stated policy, international law and the rights of Palestinians. The Canadian government would do well to review the submissions of organizations such as Al-Haq and countries such as Ireland. Urge Canada to reconsider its stance on an ICJ advisory opinion on Palestine.

Nous, soussignés, Canadiens et autres partisans de la cause palestinienne, implorons les membres de la Cour internationale de Justice (CIJ) d’ignorer la présentation faite par Alan H. Kessel, sous-ministre adjoint et conseiller juridique, Affaires mondiales, au nom du gouvernement du Canada concernant la demande de l’Assemblée générale des Nations Unies à la CIJ sur la question de la Palestine.
Le gouvernement du Canada a avancé deux raisons principales pour s’opposer au renvoi à la CIJ :
Premièrement – Israël n’accepte pas le processus.
La déclaration du Canada contredit même la position officielle du Canada. La politique canadienne dit qu’en vertu

Deuxièmement – ce n’est pas une question qui relève de l’Assemblée générale des Nations Unies, mais du Conseil de sécurité.
L’envoi de la demande de l’Assemblée générale au Conseil de sécurité des Nations Unies est une tentative à peine voilée de permettre aux États-Unis d’Amérique d’utiliser leur droit de veto pour garder l’affaire hors de portée de la CIJ.
Cette position du gouvernement du Canada est complètement erronée et inacceptable pour la plupart des Canadiens, comme l’indique le soussigné.
التماس مقدم إلى محكمة العدل الدولية (ICJ) بخصوص موقف كندا غير المقبول فيما يتعلق بفلسطين
نحن، الكنديين الموقعين أدناه وداعمين آخرين للقضية الفلسطينية، نلتمس من أعضاء محكمة العدل الدولية تجاهل العرض الذي قدمه ألان ه. كيسيلن (Alan H. Kessel) مساعد نائب الوزير للشؤون الدولية والمستشار القانوني لوزارة الخارجية باسم الحكومة الكندية بخصوص الطلب المحال إلى المحكمة من قبل الجمعية العمومية للأمم المتحدة حول المسألة الفلسطينية.
لقد قدمت الحكومة الكندية سببين رئيسيين لمعارضة هذه الإحالة:
أولاً- إن إسرائيل لا توافق على هذه العملية
يتعارض هذا العرض الكندي مع الموقف الرسمي الكندي، فالسياسة الكندية تطرح أنه حسب
“قراري مجلس الأمن الدولي رقم 446 و465، فإن المستوطنات الإسرائيلية في المناطق المحتلة تعتبر خرقاً لميثاق جنيف الرابع، [وأن] المستوطنات تشكّل كذلك عقبة جدية أمام الوصول إلى سلام شامل وعادل ودائم”
في المقابل فإن هذا العرض الكندي يعترض على قيام محكمة العدل الدولية بالنظر في موضوع المستوطنات في الضفة الغربية المحتلة.
بالتأكيد فإنه ليس ل”المحتل” أي حق في تحديد اختصاص محكمة العدل الدولية. لذا إن موقف الحكومة الكندية هذا مجرد هراء.
ثانياً- إن هذا الأمر لا يعود للجمعية العمومية للأمم المتحدة، بل لمجلس الأمن،
إن إرسال الطلب من قبل الجمعية العمومية للأمم المتحدة هو محاولة مستترة للسماح للولايات المتحدة الأمريكية باستخدام حق النقض (الفيتو) لإبعاد الأمر عن محكمة العدل الدولية.
إن موقف الحكومة الكندية هذا خاطئ تماماً وغير مقبول بالنسبة لمعظم الشعب في كندا كما يظهر من خلال التواقيع أدناه.

Whatever the World Court’s opinion on Palestine, any person with eyes to see and a heart to feel knows that there is an ongoing genocide happening… Palestinians, many of them children, are being killed in cold blood in the streets, day after day, year after year. I, like so many Canadians, am supportive of the Palestinian cause, and beseech the members of the International Court of Justice (ICJ) to ignore the presentation made by Alan H. Kessel, Assistant Deputy Minister and Legal Advisor, Global Affairs, on behalf of the Government of Canada with respect to the request by the General Assembly of the United Nations to the ICJ on the question of Palestine.
